The state of emergency, in which the Czech Republic currently finds itself by government decision, affects many different areas. One of these is the public procurement process. Since conducting procurement procedures usually requires a considerable amount of time, their progress can be significantly hindered during a crisis situation. Therefore, in this exceptional period, it is necessary to seek alternative and, above all, swift solutions to meet the needs of contracting authorities. The Public Procurement Act thus provides important exceptions for this state of emergency.
A state of crisis generally requires an appropriate response, which often cannot be carried out without adequate material support. Unlike private law entities, however, contracting authorities under the Public Procurement Act are usually required to follow a procurement procedure when concluding contracts for consideration, for which clear rules are set out in the aforementioned law.
